Pakistani brand's owner has not been very attentive towards Intellectual Property Rights. No organization or body is particularly working on a national level for providing an authentic and focus oriented platform to represent the IP owners and advocacy of their rights in Pakistan.

Our studies show that small companies are usually IP unaware. The masses of SMEs and micro-enterprises, forming the cradle of future large companies, are unaware of the IP system. Numerous organizations are facing serious business threats because of adulterated and counterfeit products and are unaware of how to stay protected from IP theft and prosper in the long run.

Most of the organizations are under the misconception of being sustainable and prosperous without having their IP registered, which translates into a major threat for them as they do not have any IP rights in Pakistan. Most of the organizations nowadays, are introducing / marketing their valuable brands and ideas without having appropriate IP protection.

This situation provides dividend to unlicensed and illegal manufacturers of popular brands for smuggling & counterfeiting of products and evasion of huge taxes because of undocumented economy.

Current Market Situation

According to WIPO, a UN specialized agency report, Pakistan is amongst the top countries where IP theft is most common. It is beyond doubt that IP is the life blood of an economy and is the biggest asset of any country and commercial entity. In Pakistan, unfortunately not a lot of emphasis is placed on its importance, awareness and implementation. This leads to more and more illegal and unfair practices and business identity theft leading to irreparable damage of the global market share and also resulting in heavy costs to the national economy of Pakistan. With reference to the command, control and regulation of IP in Pakistan, IPO is the apex government authority but unfortunately this authority has not given due attention and priority for taking effective measures for the protection of IP rights and public awareness except for only issuance of IP registrations in Pakistan. This is why the respect of IP rights is not regarded and encourages the copycats and counterfeiters in the market.
